These Terms of Use ("Terms") are an agreement between you and Apexa Tech AB, a company registered in Sweden ("we", "us", "our"), and govern your use of the Apexa mobile application ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App. You must be able to form a binding agreement to use the App; if you are a minor under the law of your country, you may use the App only with the involvement of a parent or guardian who agrees to these Terms on your behalf.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, in accordance with the Usage Rules of the Apple Media Services Terms and Conditions and these Terms. You may not copy, redistribute, rent, lease, sub-license, reverse-engineer, or attempt to derive the source code of the App, except to the extent that applicable law permits.
Apexa may offer a one-time, 14-day free period of Pro features that does not require payment. This grant is a promotional courtesy: it does not charge you, does not automatically convert into a paid subscription when it ends, and is limited to one per user. We may modify or withdraw this offer for future users at any time.
Free users may choose to watch a rewarded advertisement to earn additional serve analyses (up to a monthly cap). The reward is a courtesy with no cash value, is delivered only when the ad is completed as described in the App, and may be changed or withdrawn at any time. You are never required to watch ads to use the App's basic features.
The App offers a free tier with a limited number of analyses per month (plus the optional rewarded-ad bonus) and a Pro tier with expanded access (such as unlimited analyses, no ads, and additional features described in the App). The specific limits and features are described in the App and may be updated over time.
You agree to use the App only for lawful purposes and only to analyse footage you have the right to use. You will not misuse the App, interfere with its operation, or use it to infringe anyone's rights.
Apexa provides general, informational technique feedback only. It is NOT medical, physiotherapy, professional coaching, diagnostic, training, or injury-prevention advice, and is not a substitute for a qualified professional. Tennis and physical training carry inherent risks of injury. Consult a qualified coach and/or a healthcare professional before acting on anything the App suggests and before beginning or changing any training. You use the App and act on its feedback entirely at your own risk. Do not use the App in a way that distracts you during play or in any unsafe situation.
The App estimates body pose, joint angles, and serve phases from a single 2-D camera. These estimates are approximate and may be inaccurate, and their quality depends on video quality, camera angle, lighting, and other factors. The App's output is not a precise measurement and is not a substitute for in-person coaching or professional assessment.
The App, its design, branding, text, and any bundled reference data are owned by us or our licensors and are protected by intellectual-property laws. These Terms grant you no rights in them except the limited licence in Section 1.
To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that its analysis will be accurate.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the App's feedback or from any inability to use the App. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited — including, for consumers, liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under mandatory applicable (including Swedish/EU consumer) law. Your statutory consumer rights are not affected.
The App uses third-party services, including Apple (App Store, in-app purchases, iCloud) and Google AdMob (advertising to free users). Your use of those services is also subject to their respective terms and privacy policies. Our handling of your data is described in our Privacy Policy.
You acknowledge and agree that:
These Terms apply while you use the App. We may suspend or terminate your access if you breach these Terms or misuse the App. You may end this agreement at any time by deleting the App; deleting the App does not by itself cancel an active subscription (see Section 2).
These Terms are governed by the laws of Sweden, without regard to its conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and these Terms do not deprive you of those protections.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide notice in the App. Continued use of the App after an update means you accept the revised Terms.
